Mana Nui Automations LLC (“we,” “our,” or “MNA”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information when you visit mananuiautomations.com (the "Website") or engage our services, and it describes the choices you may have regarding that information.

This Policy applies to information we collect online through the Website and in the course of providing our services to business clients (including through email, and electronic signature). It does not apply to information processed solely on behalf of a client as part of implementing or operating a client’s automation systems, where the client controls the purposes and means of processing ("Client Data"); in those cases, the client’s privacy notices and instructions govern.

  1. DEFINITIONS

"Personal Information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual. 

“Cookies” are small files that are placed on your computer, mobile device or any other device by a website, containing the details of your browsing history on that website among its many uses.

“You” means the individual accessing or using the Website, or the company or other legal entity on behalf of which such individual is accessing or using the Website, as applicable.

When you contact us through our Website form or by email, we collect:

  • Your mailing address (including Hawaii address, if provided)

  • Message content and service inquiry details

This data is collected via standard web analytics tools and is used to operate, secure, and improve the Website, understand usage trends, and troubleshoot issues. Analytics cookies and similar tracking technologies are disabled unless and until you opt in through our cookie banner.

  1. Consent and Agreement Data

When you sign a contract or agreement with us, we log and retain:

  • Your email address, IP address, and timestamp of agreement execution (records of acceptance/consent)

  • Signed contracts via our electronic signature service

  • Payment confirmation records via our payment processor

  1. Publicly-Sourced Business Contact Information

We may collect business contact information from public sources for B2B sales, marketing, and account management. This may include name, job title, employer, business email, business phone number, business address, professional profile information, and similar business contact details from company websites, professional networking sites, directories, conference materials, press releases, regulatory filings, and similar sources.

We may use this information to identify potential customers, maintain prospect and account records, communicate about our products and services, manage customer relationships, and support related research, analytics, and business operations.

We may combine this information with information we collect directly or receive from affiliates, customers, service providers, business partners, and other lawful sources to keep our records accurate and improve the relevance of our communications.

We may share this information with our affiliates, service providers, vendors, professional advisers, and other parties as reasonably necessary for the purposes described in this Privacy Policy, and in connection with legal compliance, law enforcement requests, legal claims, or corporate transactions.

Depending on your U.S. state of residence and applicable law, you may have privacy rights regarding personal information we process about you. To submit a request, please use the contact information in this Privacy Policy.

  1. What We Do NOT Collect

MNA does not collect or store:

  • Social Security numbers or government ID numbers

  • Credit card or bank account numbers (all payments processed exclusively via our payment processor — we never see or store your payment credentials)

  • Medical or health records

  • Biometric data

  • Passwords or security credentials

  1. HOW WE USE YOUR INFORMATION

We use the information we collect to:

  • Respond to inquiries and provide requested services

  • Send our newsletter to subscribers who have opted in

  • Process payments

  • Execute and manage service agreements

  • Deliver automation systems and ongoing support

  • Send service-related communications (invoices, updates, reports)

  • Monitor and analyze usage of the Website, such as identifying usage trends, and evaluating and improving the Website and our services

  • Comply with Hawaii tax law and applicable legal requirements

We do not sell, rent, or trade your personal information. We do not use your personal information for targeted advertising, and we do not knowingly permit third parties to use information collected on the Website for targeted advertising.

  1. DETAILED INFORMATION ON THE PROCESSING OF YOUR PERSONAL INFORMATION

    1. Tracking Technologies and Cookies

We may use third-party Service providers to monitor and analyze the use of the Website.  For example, we may use Google Analytics, a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of the Website. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.  Google Analytics cookies and similar analytics trackers are disabled by default and are only activated if you affirmatively opt in through our cookie banner.

If you have opted in to Google Analytics cookies, you can withdraw your consent at any time through our cookie banner, which will disable Google Analytics cookies going forward.

We may also use the following services that process user information:

  • Microsoft Clarity, a product-analytics service offered by Microsoft that helps us understand how visitors interact with the Website. Microsoft Clarity may collect and aggregate interaction data such as pages visited, clicks, scrolling, and navigation patterns, and may capture session-replay and heatmap information about how visitors use our pages. Microsoft Clarity cookies and similar analytics trackers are disabled by default and are only activated if you affirmatively opt in through our cookie banner.   • An email newsletter service that we use to deliver our monthly newsletter to subscribers who opt in. If you subscribe, your email address is processed by this provider on our behalf to send the newsletter and confirm your subscription. The newsletter signup form on the Website is provided by this service and may use its own cookies or similar technologies to operate the form. You can unsubscribe at any time using the link in any newsletter email. We do not sell your email address.

  • A video hosting platform that we use to display educational videos on the Website. We use the platform's privacy-enhanced mode, and videos load only after you choose to play them. Once you play a video, the video platform may collect information about your device and viewing activity according to its own privacy policy.

  • See the section below regarding “Cookies and Tracking Technologies” for more information about how we collect information using tracking technologies.

  1. Payments

  • We may use third-party payment processors to process donations or purchases of products or services we offer.

  • We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. We do not receive or collect your full payment card information; however, we may receive limited payment-related information from our payment processors, such as a payment confirmation or transaction identifier. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information. 

  • For example, we may use Stripe for payment processing.  Stripe’s Privacy Policy can be viewed at https://stripe.com/privacy  

  1. AI Tools 

  • MNA may use artificial intelligence (“AI”) tools in the delivery of our services. Where AI tools are used, they may include AI-powered tools for workflow automation, chatbots, integrations, content generation, transcription, and similar functions. Some engagements may not involve AI at all — your specific service stack will be confirmed during Discovery and reflected in your Statement of Work. When AI tools are used:

  • We do not intentionally submit your information to third-party AI providers for the purpose of training their general-purpose models, except where a provider’s terms for a specific feature explicitly require such use and you have authorized that feature in the applicable Statement of Work or in writing

  • AI-generated outputs are reviewed by MNA before delivery to you

  • You are responsible for reviewing all AI-generated content before use in business, legal, financial, or medical decisions

  • Where we deploy AI chatbots or automated messaging systems on your behalf, those systems include clear disclosure to end users that they are interacting with an artificial intelligence system

  1. Meeting Recording and AI Meeting Notes

  • MNA may use AI-powered meeting transcription services to capture discovery calls, client meetings, and project consultations. This supports accurate documentation of project requirements and commitments.

  • When meeting recording is active, we may capture audio, video where applicable, meeting metadata, AI-generated transcripts and summaries, and action items extracted by AI. This information may include Personal Information you choose to share during the meeting.

  • Participants receive notice that recording is in use through:

  • Advance notice in meeting confirmation communications

  • Verbal disclosure at the start of the meeting, including the opportunity to opt out before recording begins

  • Visual or in-meeting indicators provided by the transcription service

  • Recording laws vary by jurisdiction. We provide notice and, where required, obtain consent before recording begins (including for participants located in all-party/two-party consent jurisdictions)

  1. COOKIES AND TRACKING TECHNOLOGIES

  • Our website uses cookies and similar technologies (such as pixels and local storage) to operate the Website and, if you opt in, to collect analytics. Some tracking technologies are strictly necessary to operate the Website, and others are used for analytics, performance, and similar non-essential purposes.  You control which non-essential categories are active through our cookie consent banner, which appears on your first visit and can be re-opened at any time via the cookie icon in the bottom-left corner of any page.

  • If you opt in to analytics cookies, we and our analytics providers may collect information about your device and interactions with pages to help us understand Website usage.

  1. Categories of Cookies We Use

  • Purpose: These cookies maintain consistent site behavior, preserve scroll position, and record user preference choices. These cookies are disabled unless you consent.

  • Analytics 

  • Type: Persistent, Third Party

  • Purpose: These cookies help us understand how visitors use the Website, and may track pages visited, time on site, referral source, IP address, and browser type, as well as interaction and session data such as clicks, scrolling, mouse movements, navigation patterns, and session-replay and heatmap information (for example, through tools like Microsoft Clarity).  These cookies are disabled until you grant consent.

  • Marketing 

  • The Website currently does not use marketing cookies.  If we enable marketing cookies in the future, they will be disabled by default unless and until you opt in.  Marketing cookies will be third-party and persistent if activated.

  1. Your Consent and Withdrawal

  • Your consent choices are stored in a first-party cookie which expires after 180 days. You may withdraw consent at any time by clicking the cookie icon in the bottom-left of any page and selecting “Reject all” or adjusting category preferences. Withdrawing consent stops new tracking. To request deletion of analytics data associated with you where feasible, contact us at lennie@mananuiautomations.com.

  1. DISCLOSURE OF YOUR PERSONAL DATA

    1. Law Enforcement

  • Under certain circumstances, MNA may be required to disclose your Personal Information if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

  1. Other Legal Requirements 

  • MNA may disclose your Personal Information in the good faith belief that such action is necessary to:

  • Comply with a legal obligation

  • Protect and defend the rights or property of MNA

  • Prevent or investigate possible wrongdoing in connection with the Website

  • Protect the personal safety of users of the Website or the public

  • Protect against legal liability

  1. DATA RETENTION

  • MNA retains your data as follows, and may retain certain information longer where required or permitted by law (including for tax, accounting, dispute resolution, and backups):

  • Signed contracts, records of acceptance/consent, and invoice records: at least 7 years following the end of engagement, consistent with tax and business recordkeeping requirements and the 6-year statute of limitations for contract disputes

  • Contact form submissions: retained for the duration of our business relationship plus 2 years

  • Newsletter subscriber information: retained until you unsubscribe or ask us to delete it

  • Meeting recordings and AI-generated meeting summaries: retained for the duration of the active client engagement plus 2 years, then permanently deleted

  • Website analytics data: retained for 24 months

  • After the applicable retention period, records are destroyed using reasonable measures designed to render the information unreadable or undecipherable, subject to our recordkeeping obligations. You may request confirmation of deletion for specific records, where feasible, by emailing lennie@mananuiautomations.com.

  1. DATA SECURITY

  • We implement reasonable technical and administrative measures to protect your information, including:

  • Secure transmission via HTTPS for all website communications

  • Encrypted contract execution via our electronic signature service

  • PCI-compliant payment processing via our payment processor

  • Access-restricted storage for client records

  • In the event of a security breach involving "personal information" (as defined under Hawaii HRS Chapter 487N) that we maintain, we will provide notices required by applicable law, including Hawaii HRS Chapter 487N, without unreasonable delay and consistent with any law enforcement needs and measures necessary to determine the scope of the breach and restore the reasonable integrity of the system.

  1. THIRD-PARTY SERVICES

  • Our services and the Website may use third-party providers for payment processing, electronic signatures, website hosting, web analytics, email newsletter delivery, video hosting, AI-powered meeting transcription, and automation infrastructure. These providers process information on our behalf (and/or as independent controllers under their own terms) to support the Website and our services. Their privacy practices are governed by their own policies, and we encourage you to review them.

  • MNA may maintain affiliate or referral relationships with certain recommended software providers. Where such a relationship exists, we may receive a commission or referral credit at no additional cost to you. When affiliate links are used, the third-party provider may use cookies or similar technologies to attribute the referral, subject to your cookie choices on our Website and the third party’s own practices. All recommendations are based on technical suitability for your business needs, and you are under no obligation to use any specific tool. Third-party platform subscription fees are your sole responsibility and are billed directly by the respective providers.

  1. Your Right to Opt Out

  • You may opt out of meeting recording at any time, before or during a meeting, by replying to your meeting confirmation, stating your preference verbally at the start of the meeting, or emailing lennie@mananuiautomations.com in advance.

  • Opting out does not affect your ability to engage our services or schedule meetings. When recording is disabled, we will take manual notes instead.

  1. Use of Recordings

  • Meeting recordings, transcripts, and AI summaries are used to document project requirements, support the preparation of proposals and Statements of Work, and maintain a record of mutual agreements during active engagements. Recordings and summaries are not used to train AI models, are not shared with third parties beyond the meeting service provider, and are not used for marketing purposes.

  1. “DO NOT TRACK” POLICY

  • The Website does not respond to Do Not Track ("DNT") browser signals.

  • However, some third-party websites do keep track of your browsing activities. You can manage non-essential cookies and similar tracking technologies on the Website through our cookie banner or preference center (where available). If you are visiting third party websites, you can set your preferences in your web browser to inform those websites that you do not want to be tracked.

  1. CHILDREN’S PRIVACY

  • Our website and services are not directed at individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected information from a minor, please contact us immediately at lennie@mananuiautomations.com.

  1. LINKS TO OTHER WEBSITES

  • The Website may contain links to other websites that are not operated by MNA. If you click on a third-party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit.

  • We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

  1. YOUR PRIVACY CHOICES

  • You may request access to, correction of, or deletion of certain Personal Information we maintain about you, subject to applicable law and our recordkeeping obligations. 

  • Please note, however, that we may need to retain certain information when we have a legal obligation or lawful basis to do so.

  • To submit a request, email lennie@mananuiautomations.com with the subject line "Privacy Request" and describe your request; we may need to verify your identity and, where applicable, your authority to act on behalf of a business before processing your request.

  1. CHANGES TO THIS POLICY

  • We may update this Privacy Policy periodically to reflect changes in our practices or applicable law. We will post the updated policy on our website with a revised effective date. Your continued use of the Website after such changes means you accept the updated policy.

  • If we make material changes, we will take reasonable steps to provide additional notice (for example, by posting a prominent notice on the Website).
